Terms and Conditions
Welcome to GlobalCashbacks.com. GlobalCashbacks (Provider) offers a service (Cashback Service) for its members (Users), registered under the domain GlobalCashbacks.com and the Cashback program described below.
In these general terms and conditions, the following terms are used in the following sense, both in singular and in plural, unless expressly stated otherwise or if the context proves otherwise;
Provider: GlobalCashbacks is owned and managed by GT Webdiensten. A Dutch internet company, which is registered with the Chamber of Commerce in The Netherlands under number 69475288.
Account: the personal environment of the User containing the personal details and the status of the Credit and which forms part of the Services.
Cashback (Service): Cashback literally means 'money back'. By GlobalCashbacks you can click through to your favorite webshop(s). If you make a purchase at a webshop, through GlobalCashbacks, you will receive Cashback (a commission). The Cashback you earn on GlobalCashbacks consists of a fixed amount per purchase, a number of cashback points or a percentage of your purchase amount. The Cashback varies per webshop and possibly per Product group or Product within the webshop;
Computer: computer, PC, laptop, tablet, mobile phone or other equipment with which connection to the internet can be made;
FAQ: frequently asked questions;
User: the natural person or legal entity that creates an Account on GlobalCashbacks and enters into an Agreement with it.
Qualifying Transaction: Transaction that meets all the conditions of GlobalCashbacks;
Members: registered users of GlobalCashbacks;
Us: GlobalCashbacks, the provider of the Cashback Service;
Agreement: the agreement to participate in the Cashback program between the Provider and the User;
Product: the product and / or service offered by the webshop;
Product group: group of products and / or services offered by the webshop, for example clothing, toys, books, games, laptops, etcetera;
Credit: the credit in Euros that the User has built up through Transactions and that can be managed by the Account;
Transaction: the purchase of a product or service at a webshop that is carried out by the User on the website of the webshop in question;
Reference: refer a new member to GlobalCashbacks;
We: GlobalCashbacks, the provider of the Cashback Service;
(Web) site: the website GlobalCashbacks.com and associated applications.
For membership, we do not charge you any costs. Membership is free and will stay free in the future.
4) Our Services / Service
Our Cashback Service enables Users who register on the Site and thus create an Account with us, to refund money from, tracked, purchases from webshops listed on the Site. To qualify for Cashback, the web shop must confirm that the purchase of the User is complied with, is genuine and successful (a "Qualifying Transaction") and your resulting cashback must be received by us from the relevant webshop ("Cashback" if a result of this).
5) Becoming a member
You must be at least 18 years or older and legally competent to participate in GlobalCashbacks. You must register for the Cashback Service with accurate and up-to-date information about yourself - including your correct name, address and any other requested information. If you are asked for details of a bank account where you want to receive your payments (your "payment method"), you must ensure that you provide correct and complete information about your bank account and/or your PayPal-account. You must keep this information accurate and complete by your Account.
Important: You must ensure that the e-mail address you use is kept up-to-date and that you have full access to it. We send important messages to your e-mail address. If you change an e-mail address, you must adjust / keep track of this in your Account.
6) Cashback fees
The user will receive access to Cashback after registration and can use the Cashback Service from that moment on. The Cashback you earn on GlobalCashbacks consists of a fixed amount per purchase, a quantity of cashback points or a percentage of your purchase amount. The Cashback varies per webshop and possibly per Product group or Product. The Cashback is calculated on the total purchase price excluding VAT and shipping and other costs. The Cashback is offered by GlobalCashbacks and not by the webshops. The Cashback is not displayed during the ordering process at the webshop, but is only displayed in your Account at GlobalCashbacks.
If the User visits the webshop by the link from GlobalCashbacks, the User must be logged in on the Site to receive a Cashback. It is important that the User does not close the browser during the ordering process and that the User does not surf to another website. Otherwise the Cashback can not be assigned to the User.
A Cashback Transaction can have the following statuses:
Keep in mind that there are various circumstances in which a transaction with a web shop does not lead to a Qualifying Transaction, and that therefore there is no entitlement to Cashback.
The User understands that all Transactions performed by him / her do not take place on GlobalCashbacks, but on the site of the relevant webshop. Our help-page (FAQ) provides further information about these conditions. From time to time, webshops may increase or decrease the commission paid, in which case the cash back on our site may be incorrect. By default, your valid Transactions are credited as cashbacks in your Account in accordance with the commission reported by the webshop, which is less or more than the mentioned cashback on our Site. We are not liable for any difference in the expected Cashback by the User and the actual Cash Back received by the User.
When we have processed a paid Qualifying Transaction to your Account, we will credit your Account with a 'pending (payment)'. As soon as the webshop confirms the transaction, the payment is marked as 'completed' - this can take 90 days or more from the purchase date. If the goods are returned or the sale is reversed or changed, the Cash Back is not granted. If the webshop does not attribute the purchase to you, for whatever reason, and we do not receive a commission for your transaction, you will not receive a Cashback as a User.
Whether a Transaction qualifies for a Cashback Transaction is at the discretion of the webshop or us and the User understands this and agrees. We will not be held liable if the webshop does not report sales to us or does not qualify a transaction as Qualifying Transaction. In addition, we are not liable in the event of technical or other error, we can not trace a sale back to the User and do not qualify the transaction as a Qualifying Transaction, for whatever reason. While we will strive for no unpaid payments from the web shop, the decision of ourselves, the webshop owner or the agency that represents the web shop is final. While we will try to remedy the missing cashbacks, we reserve the right not to investigate claims further, especially where no purchase has been made.
When a User sends us a question about a missing Cashback, our system checks whether the User has visited the Webshop by the Site on the date stated by the User. If no reference to the web shop can be followed, we will send a message to the User indicating that the User has not clicked through our website to get Cashback for the Transaction.
All references to Webshops are stored in our cross-reference database when allocating cashback values. When a Cashback request has been successfully paid by a webshop, you can receive a lower amount than expected; this is because the amounts received by ourselves may be lower than the original claim. We allow you to request this from us. If a webshop has not yet paid the commission after a period of six months, we reserve the right to close the application request.
We reserve the right to claim back or make adjustments to your Credit if a Cashback has been incorrectly and / or incorrectly assigned to your Account. This includes, but is not limited to, Transactions where the credit is not really due or payment for a Transaction has not been received from a web shop or its agencies and / or abuse or fraud. This may include Transactions that have already been marked as completed in your Account, or for Transactions that have already been paid to you.
There are various circumstances in which Cashback will not be paid to the User. This can be without limitation:
where the Cashback payment we receive is not attributed to a Qualifying Transaction or linked to an Account (such as where the User is not logged in on our Site when making the relevant Transaction);
GlobalCashbacks can not guarantee that the Cashback can be used in combination with other savings or discount promotions (for example a savings or discount promotion of the webshop itself).

7) Refer new members (referrals)
The User has a unique GlobalCashbacks referral link with which the User can refer other people to become a member of GlobalCashbacks. GlobalCashbacks has one Referral level.
The User is not permitted to promote his or her referral link in newsgroups, in unsolicited e-mail messages or through other methods that may lead to complaints. This is seen as SPAM.
8) Pay out Credit
You can have your validated Cashback paid out if you have at least ten euros in your Credit. There are no costs associated with a payout. If you decide to terminate your Account with us, before the ten euro limit has been reached, there are five euro transaction and administration costs on closing the Account by yourself.
Payments are made to bank accounts and/or PayPal-accounts. A bank account and/or PayPal-accountmay only be used for one Account, unless GlobalCashbacks has given permission for a bank account and/or PayPal-account to be used for several Accounts. If a bank account and/or PayPal-account is used with several Accounts without the permission of GlobalCashbacks, these Accounts will be blocked and the accumulated Credit will be canceled. Only members from SEPA countries are paid by bank transfer. Non SEPA-countries members are paid by PayPal. SEPA stands for Single Euro Payment Area. Click here to see which countries are SEPA countries. If you are a member from a SEPA country and you prefer to be paid by PayPal then leave your IBAN account number blank and fill in your PayPal address.
If a payment of cashback by bank transfer or by PayPal Transfer is rejected by the bank or PayPal for any reason (other than an error on our part), we may charge to you an administration fee of 15 euro (by redeeming any cashback balance in your Account to that value or by asking you to pay us that amount). Otherwise, you will not be charged any fees for a bank or PayPal transfer. These fees will be borne by us.
GlobalCashbacks will not proceed to pay the credit if GlobalCashbacks can prove that the earned cashbacks have been obtained in an unlawful way. GlobalCashbacks tries to process the payment request within one week. However, GlobalCashbacks can not guarantee that this period will actually be met, nor does it accept any liability for damage caused by exceeding this period.
9) Intellectual Property
All content and material on the Website and Service or sent to you in a GlobalCashbacks email is protected by Dutch and international copyright law, and may also be protected as a trade mark, service mark, or under other rights and laws.
Except for the creation of a temporary copy on your computer which is inherent to the process of the normal use of the Website or Service, the content and material referred to above may not be copied, reproduced, published, stored in a retrieval system, altered or otherwise used in any form or by any means, in whole or in part, without our prior written approval, or the approval of the relevant copyright owner.
10) Linking from External Websites
www.globalcashbacks.com is happy for other websites to link to it; however, it does not permit pages to be loaded into frames on other sites. It does not permit links from any websites that contain material which could be construed as offensive.
12) Position of GlobalCashbacks
We are not a party to Transactions with webshops and are not the seller or supplier of the goods or services that they make available. For example, we have none of the legal obligations that apply to the sellers of those goods or services.
Therefore, we have no control over or responsibility for the quality, safety or legality of those goods or services available from the webshops on our Site. Users should not exercise a lesser degree of caution when entering into Transactions with the webshops that are listed on GlobalCashbacks than they would when entering into a similar Transaction offline. To the extent permitted by applicable law, you release us, our agents and employees from all liability arising out of or in connection with Transactions with webshops, including (without limitation) all claims and demands with regard to unfinished or completed Transactions with web shops or goods or services offered or sold or supplied by or in connection with Transactions with webshops that are mentioned on GlobalCashbacks.
13) Financial Products
The User can purchase financial products on the Site. GlobalCashbacks does not have an license (from authority on financial markets) and therefore never gives advice on financial products. The User can contact GlobalCashbacks on the contact form on the Website. GlobalCashbacks answers questions about the Cashback program. GlobalCashbacks does not answer any questions about financial products. For advice about financial products, always consult an authorized party.
We reserve the right to suspend or terminate all Users access to our service or parts thereof, if we have a reasonable suspicion that the relevant member or Account is acting contrary to a provision of this Agreement.
Users may not enter into or attempt to enter into a Transaction with a web shop or obtain Cashback (a) by providing someone else's personal information or a payment method that they are not permitted to use, b) by fraudulently or unjustly making use of a web shop offering, including but not limited to the creation of fake or unauthorized referral links, or (c) in violation of the conditions adjusted by us or the webshop in this Transaction. We reserve the right to cancel any unpaid payments or validated payments in the member Account in case of misuse of our service by the User.
If you see or experience something on our Site that violates any of the above requirements, we would like to request that you inform us by using our contact form on the Site.
Each User acknowledges that we have the right, but are not obliged, to withdraw material that appears to be in violation of this Agreement on the basis of information from third parties or other Users.
15) Third party contact
If someone contacts us in relation to material or Transactions connected to you or your Account, you agree to: provide all reasonable information and assistance that we may require in connection with the response to that contact; and to respond quickly and accurately when we pass the message to you for an answer.
16) Additional Services
We or our partners may from time to time offer new or additional services through the Site. Your use of these services may be subject to additional conditions that you must fulfill. With the proviso that these conditions are registered on the Site in an appropriate way (as determined by us to our reasonable discretion).
17) Operation of our Cashback Service
We reserve the right to withdraw, modify or suspend the aspects of the Cashback Service, or all of it, where we have legal, safety, technical or commercial reasons to do so. We will try to inform you 30 days in advance before taking such measures, except when it is necessary to do earlier security reasons or technical difficulties that would otherwise affect the service. There may also be times when the Cashback Service becomes inaccessible due to technical problems experienced by us or on the internet.
However, we will use reasonable skills and care to overcome these difficulties wherever they are in our control. Please note that we can not guarantee that you have continuous access to the Cashback Service or any of the content on it.
Nevertheless, we will ensure that every period of planned unavailability is kept to a minimum. In the event of planned unavailability, we will notify you in advance.
For security or other reasons, we may need to change information that facilitates access to the Cashback Service.
We never ask you your password by e-mail, telephone or in any other way.
You are solely responsible for maintaining the confidentiality of your password and any additional identification information.
18) Force Majeure and Limitation of Liability
GlobalCashbacks is not obliged to fulfill any obligation if it is prevented from doing so as a result of force majeure. Force majeure includes: a non-attributable shortcoming of third parties engaged, internet failure, power failure, virus infection, weather influences, government measures, computer intrusion, as well as any other situation where GlobalCashbacks can not exercise (decisive) control.
GlobalCashbacks strives to keep the services accessible on the Website seven days a week and twenty-four hours a day. However, access may interrupt, inter alia due to maintenance work, updating and / or for another technical reason.
GlobalCashbacks can never guarantee that the data on the Website are correct. GlobalCashbacks will make every effort to keep the accuracy of these data as consistent as possible. Influences from outside, for example hackers, are always possible and can lead to disturbed data. GlobalCashbacks is not liable for these disturbed data.
GlobalCashbacks is not liable for damage, of whatever nature, because GlobalCashbacks is based on inaccurate and / or incomplete information provided by the User. GlobalCashbacks can in no way be held liable for the loss of a password applied by the User. GlobalCashbacks can therefore not be held responsible if unauthorized third parties use the e-mail address and password of the User.
It is possible that the information that is displayed by the Website is incorrect and / or incomplete. GlobalCashbacks can not guarantee that information made available by the Website about webshops is correct and up-to-date.
GlobalCashbacks is not responsible for the quality, completeness, safety or legality of a Product that has been purchased by the Use at a webshop.
The limitations of liability for direct damage included in these general terms and conditions do not apply if the damage is due to intent or deliberate recklessness of GlobalCashbacks.
19) Content of Third Parties
Third-party content and materials may appear on the Site or may be accessible through hyperlinks from the Site. We are not liable for and assume no liability for errors, inaccuracies of the law, slander, omissions, lies, obscenity, pornography or sacrilegiousness in the statements, opinions, representations or other content and materials that are accessible on the Site or accessible by hyperlinks of the Site.
You agree to indemnify us against all liability, claims and costs arising from or in connection with (a) any violation of this Agreement by you or through your Account, or (b) a Transaction with a webshop.
21) Full Agreement
This Agreement is intended to contain your entire agreement with us about the Cashback Service. We think it's fair and reasonable. It replaces all prior agreements and agreements with you regarding the Cash Back Service that we provide.
22) Changes to this Agreement
We reserve the right to change this agreement from time to time and to place the new version on the Site. When we do so, we will post the new version of the Agreement on the Site and the new version of these terms will become effective and will manage the Cashback Service and your relationship with us. Our Terms and Condtions were last modified on 27 January 2019.
23) Duration and Termination
The Agreement is entered into for an indefinite period of time. The Agreement can be terminated at any time by the User or GlobalCashbacks.
We reserve the right to cancel your membership and your Account, and terminate your use of the Service, with 7 days' notice, if your membership Account becomes Inactive. Your Account becomes “Inactive” if you do not log in to the Website and click through to a merchant's website at least once in any 12-month period. To prevent your membership account from becoming Inactive, it is sufficient for you to simply log in to the Website and click through to a merchant's website a minimum of once in any 12-month period.
All cashbacks (whether pending or confirmed or accrued or not) held in an Inactive Account will expire at midnight (Amsterdam, The Netherlands, time) on the date that the Account becomes Inactive (the “expiry date”). Subject to preceding paragraph, expiry of cashbacks will not itself result in closure of a member's Account but the applicable cashbacks will be immediately and irreversibly cancelled and will not be available to the member. We will use reasonable endeavours to provide you with prior written notification of the date on which your cashbacks will expire (if your Account becomes Inactive).
24) Questions and Complaints
If you have an enquiry or complaint about a particular merchant, business, advertisement, link, email, or survey, you may contact us. We will do our best to answer your question or resolve the issue, however in some circumstances we may need to direct you to contact the merchant, business or advertiser directly.
Questions or complaints about the Website, the Cashback program and the other services of GlobalCashbacks can be directed by the User by using the contact form on the Site.
Complaints and / or questions about a Product and / or Service must be submitted by the User to the relevant webshop that offers the Product and / or Service or from whom the User has purchased the Product and / or Service.
In the event that any expression of this Agreement is invalid or unenforceable, the remainder of this Agreement remains valid and enforceable. You and we are independent contractors, and no relationship between agencies, partnerships, joint ventures or employee-employers is intended or created through this Agreement. Our failure to act in relation to a violation by you or others does not affect our right to act in connection with subsequent or similar infringements.
26) Governing Law
This Agreement, and our relationship with you and each Member, is governed by the laws of the Netherlands ("applicable law"). The application of the Vienna Sales Convention (CISG) is explicitly excluded.
The judge in Leeuwarden (location of GlobalCashbacks) has exclusive jurisdiction to hear disputes, unless mandatory law stipulates that the dispute must be submitted to another court. The User has a period of one month after GlobalCashbacks has invoked this clause in writing with regard to the User, in order to choose the court that is competent according to the law for the settlement of the dispute.
27) Save this Agreement
We do not provide you with a copy of these General Terms and Conditions when you enter into the agreement. You can access this by GlobalCashbacks.com. We recommend that you make a copy of this Agreement by printing and / or saving a downloaded copy on your own computer. The Agreement is only offered in English. Our Terms and Condtions were last modified on 27 January 2019.
